These Terms of Use ("Terms") govern your use of the website at bpresidentialheating.com and any related tools or communications provided by BP Residential Heating & Cooling LLC ("BP," "we," "us," or "our"). By accessing or using the site, you agree to be bound by these Terms.

You must be at least 18 years old to use this site, submit our contact form, or opt in to SMS communications. By using the site, you represent that you meet this requirement.

3. Ask BP virtual assistant

The "Ask BP" assistant is provided to help answer general questions, collect service details, check service-area fit, show available visit windows, and book an appointment after you choose an exact returned window, provide the required details, and explicitly confirm. Conversations may be recorded, stored, and processed as described in our Privacy Policy. The assistant's responses are generated by automated technology, may not be accurate or complete, and do not constitute professional, technical, safety, or contractual advice or any commitment by BP. An appointment should be treated as scheduled only when the booking tool returns a successful booked response; otherwise BP may need to follow up directly. 4. SMS & phone communications

By providing your phone number to us — through our website, our assistant, by phone, text message, or otherwise — you agree that BP may contact you by phone call and text message (SMS) regarding your inquiries, estimates, appointments, service, and follow-ups.

Service description

SMS messages may include responses to inquiries, appointment confirmations, scheduling updates, service-related notifications, and follow-ups for recipients who have provided their number.

Consent

Your consent is voluntary and is not a condition of any purchase or service. We do not send recurring marketing or promotional text messages.

Message frequency & cost

Message frequency varies based on your interactions with us. Message and data rates may apply. Carriers are not liable for delayed or undelivered messages.

Opt-out & help

Reply STOP to any message to opt out at any time; you will receive a single confirmation and no further messages unless you opt in again. Reply HELP, or call (585) 978-1492, for assistance.

TCPA

We comply with the Telephone Consumer Protection Act (TCPA) and applicable federal and state laws governing calls and SMS messaging.

5. Intellectual property

The site, including its content, design, code, branding, and the BP Residential Heating & Cooling name and logo, is owned by or licensed to BP and protected by applicable laws. You may not reproduce, distribute, or create derivative works from any part of the site without our written permission.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BP RESIDENTIAL HEATING & COOLING LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE OR ITS TOOLS. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SITE OR ITS TOOLS SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). Nothing in these Terms limits liability that cannot be limited under applicable law, and these Terms do not alter the separate terms of any service agreement for work performed at your property.

10. Governing law

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws principles. Any dispute arising under these Terms shall be brought exclusively in the state or federal courts located in Monroe County, New York.

11. Changes

We may update these Terms from time to time. The effective date above reflects the most recent revision, and continued use of the site after changes constitutes acceptance of the updated Terms.
